These Terms of Service ("Terms") govern your use of HostMetrics ("Service"), operated by Lackner Consulting ("Company", "we", "us", or "our"), a company registered in Switzerland.

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

2. Definitions

• "Service" refers to the HostMetrics web application at hostmetrics.ai
• "User" refers to any individual or entity using the Service
• "Subscription" refers to a paid plan providing access to the Service
• "Analysis" or "Credit" refers to a single property market analysis
• "Content" refers to data, reports, and analyses provided by the Service

3. Account Registration

• You must provide accurate and complete information during registration
• You are responsible for maintaining the security of your account credentials
• You must be at least 18 years old to use the Service
• One account per person or entity is permitted
• We reserve the right to suspend or terminate accounts that violate these Terms

4. Subscription and Payments

• Subscriptions are billed monthly or annually in advance
• Payments are processed by Paddle.com, our Merchant of Record
• Paddle handles all payment processing, invoicing, and tax compliance
• Credits (analyses) expire at the end of each billing cycle
• Unused credits do not roll over to the next period
• Prices may change with 30 days advance notice
• You can cancel anytime; access continues until the end of your billing period

5. Service Description

HostMetrics provides market analysis data for short-term rental properties.

6. Acceptable Use

You agree NOT to:

• Use the Service for any illegal purpose
• Scrape, copy, or redistribute our data without permission
• Share account credentials with third parties
• Attempt to reverse engineer the Service
• Use automated systems (bots, scrapers) to access the Service
• Resell or sublicense access to the Service
• Interfere with or disrupt Service operation

7. Intellectual Property

• All content, design, and code is owned by Lackner Consulting
• You receive a limited, non-exclusive license to use the Service for its intended purpose
• You may not copy, modify, or distribute our content without written permission
• User-generated content (saved analyses, notes) remains your property

8. Data and Privacy

• We collect and process data as described in our Privacy Policy
• By using the Service, you consent to our data practices
• We comply with GDPR and applicable data protection laws

9. Disclaimers

• We do not guarantee uninterrupted or error-free service
• We are not responsible for third-party data accuracy
• Data should not be the sole basis for investment decisions
• Past performance of rental properties does not guarantee future results

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Our total liability is limited to the amount you paid us in the last 12 months
• We are not liable for indirect, incidental, special, or consequential damages
• We are not liable for lost profits, data loss, or business interruption

11. Indemnification

You agree to indemnify and hold harmless Lackner Consulting, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service or violation of these Terms.

12. Termination

• You may terminate your account at any time through your account settings
• We may terminate accounts that violate these Terms without prior notice
• Upon termination, your right to use the Service ends immediately
• We may retain certain data as required by law or for legitimate business purposes

13. Changes to Terms

• We may update these Terms at any time
• Material changes will be notified via email to registered users
• Continued use after changes constitutes acceptance of the new Terms

14. Governing Law

These Terms are governed by the laws of Switzerland. Any disputes shall be resolved in the courts of Thurgau, Switzerland.
